Controlled Substances

Schedule I and II drugs are classified as controlled substances, and they include substances with a high potential for abuse and no accepted or limited accepted medical uses.

The Fourth Amendment protects against unreasonable searches and seizures. If law enforcement conducted an unlawful search without a warrant or without a valid exception, the evidence may be suppressed.

Potential Defenses

Valid Prescription: If an individual has a valid prescription for a Schedule II drug, they may have a defense against possession charges. However, improper use or distribution of prescription medications can still lead to legal consequences.
